Jury Sides with ERP Purchaser - Big Time

As originally reported in Managing Automation, ERP supplier Ross Systems was fined $61M in a case brought by an Alabama customer. As has been later reported, customer Sunshine Mills had purchased a beta version of the enterprise software in 2005, to the tune of about $235K. The case was appealed by Ross, who also countersued the pet food maker. Ross's parent, CDC, declared Chapter 11 later in 2011, and is now part of APTEAN.

Current status of the case? There was a settlement agreement just before the bankruptcy filing, under which Ross agreed to pay only $9M.
